Terms of Use for our Business Services

This is a non-binding courtesy translation provided for convenience only. The German version of these Terms of Use is the sole legally binding version. In case of discrepancies between this translation and the German original, the German version shall prevail.

1. Scope

denkbares GmbH, John-Skilton-Straße 8, 97074 Würzburg (“denkbares GmbH”) offers various business services on the Internet. They serve the exchange of business data between denkbares GmbH and its employees, customers, prospects, and affiliated companies.

These Terms of Use govern the use of the services mentioned above. By registering for or using the services, the user accepts these terms as binding.

2. Requirements for Use

  1. Use of the services requires that the user has reached the age of 16.
  2. The user is obliged to provide truthful information during registration and to keep it up to date.
  3. Before first use, the applicable privacy agreement must be read and accepted. Without acceptance of the privacy policy, use of the services is not permitted.

3. Permitted Content and Obligations of the User

  1. The user must not upload, store, or process any content via the services that
    • is of a private or non-business nature,
    • violates applicable law (illegal content),
    • is protected by copyright or other third-party rights, unless the user holds the required usage rights.
  2. The user is solely responsible for all content they submit. The user shall indemnify the provider against any claims resulting from a violation of paragraph 1.

4. Access Credentials and Security

  1. Use of the services is only possible after entering a username and password.
  2. Users are expressly recommended to use a second authentication factor. Setup is available at id.denkbares.com.
  3. Access credentials must be treated confidentially and protected from access by third parties.
  4. In case of loss, theft, or suspected unauthorized access to access credentials, the user must notify denkbares GmbH immediately so that the account can be locked.
  5. Disclosure of data stored in the services to unauthorized third parties is prohibited.

5. Availability, Data, and Backups

  1. denkbares GmbH strives to provide the services as free of disruptions as possible, but does not owe any specific availability unless separately agreed.
  2. It is not guaranteed that backups of the data submitted by the user exist. The user is responsible for creating their own backup copies of their data.

6. Availability and Liability

denkbares GmbH does not guarantee the continuous availability of the offered services and the data contained therein. The existence of backup copies is likewise not guaranteed.

denkbares GmbH is not liable for damages arising from the use of the service, unless such damages are attributable to willful misconduct or gross negligence.

7. Privacy
